Apex Court orders to dismiss 7 Ministers
KATHAMNDU: The Supreme Court has issued an interim order barring 7 ministers who are not MPs as ministers.
Prime Minister Cholendra Shamsher Rana’s has issued an interim order to home and affairs Minister Ram Bahadur Thapa Badal, Minister for Energy, Water Resources and Irrigation Top Bahadur Ramaji, Minister of Industry, Commerce and supply, Minister of Urban Development Prabhu Sah, Labor Minister Gaurishankar Chaudhary, Minister of Water Mani Thapa and Sports Minister Dawa Lama not todo any work as ministers.
Ministers who attend office have left the Maoist Centre and entered the Communist Party . These leaders, who were MPs from the previous Maoist, had entered Amalia without returning to the Maoist Centre after the Supreme Court’s decision on February 23 to separate Amalia and Maoist Centre. Ministries handled by former Maoist leaders are vacant after a Supreme writ .
Advocate Viraj Thapa and Advocate Kapildev Dhakal had written to the Supreme Court saying it might be contrary to the Constitution to repeat the one that was not a member of Parliament.
The Constitution provides for a member of Parliament within 6 months if he becomes a non-parliamentary minister. But the Supreme has stated that the reappointment of these who have not been ready to become members of Parliament – even once they need been ministers – is contrary to the law of Sections 78, 2 and three of the Constitution, the core of the Constitution and therefore the spirit.
